Terms of Service

1. Who we are, and what you are agreeing to
1.1 K Headshot ("K Headshot", "we", "us", "our") is operated by Epikohub LLC, a California limited liability company, located at 12100 Wilshire Blvd, 8th Floor, Los Angeles, CA 90025.
1.2 These Terms of Service ("Terms") are a binding contract between you and us. They cover your use of the K Headshot website at kheadshot.com and everything you can do there (together, the "Service").
1.3 By using the Service, uploading a photo, or buying credits, you accept these Terms. If you do not accept them, do not use the Service.
1.4 Two other documents are part of this contract and are incorporated by reference:
- the Privacy Policy at /legal/privacy, which explains how we handle your photo; and
- the Refund and Credits Policy at /legal/refund, which explains what you are buying and when you can get your money back.
1.5 The Service is offered to people in the United States only. We do not target, and do not knowingly serve, users outside the United States.
2. You must be an adult
2.1 You must be at least 18 years old to use the Service. If you are under 18, you may not use the Service at all, even with a parent's permission, and even if you only want to look around.
2.2 By using the Service, you represent and warrant that: (a) you are at least 18 years old; (b) you have the legal capacity to enter into this contract; (c) you have not previously been suspended or banned from the Service; and (d) your use of the Service follows all laws that apply to you.
2.3 If you let someone else use your device to reach the Service, you are responsible for what they do. You agree to actively prevent anyone under 18 from using the Service through you.
2.4 We do not run automated age verification, and we do not analyse your photo to estimate anyone's age. Our controls here are this contract, the confirmation you tick before you upload, and the reporting channel in Section 11. If you believe a minor has used the Service or appears in an image made with it, tell us at abuse@kheadshot.com and we will act.
3. What the Service is — and what it is not
3.1 It is AI, and we say so. Every image the Service produces is generated by an artificial intelligence model. It is not a photograph of you. It is a new image built from your photo. We will never present our output as an unedited photograph, and neither should you in any context where that matters.
3.2 It is not a photography studio. No photographer, retoucher, or human being reviews your image before it is delivered. The Service is automated.
3.3 It will not look exactly like you. AI models change faces. We instruct the model to preserve your identity, your skin tone, and your features, and we do not ask it to lighten skin or westernize features. We cannot guarantee the result. Likeness is a matter of opinion, and the model's behaviour is not fully under our control.
3.4 How previews relate to the file you pay for. The free preview is a sample of the style, not a proof of the exact file: a high-resolution render is a separate generation, and the same model asked twice produces two different images, so details such as hair strands, fabric texture, background, and expression can differ from the free preview. However, before a credit is spent you are shown a watermarked preview of the actual high-resolution render, and the file you download is that exact render at full resolution without the watermark. This matters for refunds — see the Refund and Credits Policy.
3.5 We use third-party AI providers. We do not build or train the underlying image models. We send your photo and a text instruction to a third-party model provider and receive an image back. We do not control that provider's training data or its behaviour. Section 5 of the Privacy Policy names the provider and describes the commitments it has made to us.
3.6 We may change the model. Model providers replace their image models regularly. When ours changes, output may change too. We are not obliged to keep any particular model, style, or look available.
4. The photo you upload
This is the most important section in these Terms. Please read all of it.
4.1 Upload only photos of yourself. You may upload a photo only if you are the person shown in it. Do not upload a photo of a friend, a partner, a family member, a coworker, a client, a public figure, a celebrity, a K-pop idol, an actor, a model, a stranger, a person you found on the internet, or a person who does not exist as a real photograph of themselves.
4.2 One face. Upload a photo showing one adult person — you. Do not upload group photos.
4.3 No minors, ever. You may not upload, submit, or attempt to generate from any photograph, image, or likeness that depicts a person under 18 years of age. You represent and warrant that every individual depicted in anything you upload, and in any output you generate, is 18 years of age or older. This rule is about who appears in the picture, and it applies no matter how old you are.
4.4 What you promise about your photo. Every time you upload, you represent and warrant that: (a) you are the person shown in the photo; (b) you are at least 18 years old and so is everyone visible in the photo; (c) you own the photo or otherwise have the right to upload it and to have an AI-generated image made from it — including where a photographer, studio, or app holds copyright in the original; (d) the photo is not a picture of someone else's face, a picture of a screen showing someone else's face, or an AI-generated face; and (e) uploading it does not break any law or any agreement you are under.
4.5 Why we do not accept photos of other people. Making an AI image of someone's face involves handling information about their face. In several US states, that requires that person's own informed, written permission — a promise from you that you got their permission is not a substitute. Limiting uploads to your own face is how we keep that clean for everyone.
4.6 If you break this section, we may refuse the request, refuse service, suspend or terminate your access, and keep a record that we did so.
5. Government identification documents — you may not use our images
5.1 You may not submit, or attempt to submit, any image created with the Service in an application for: (a) a passport; (b) a visa; (c) a driver's license or state ID card; (d) any other government-issued identification document; or (e) any official immigration, citizenship, security-clearance, or licensing process that requires a photograph.
5.2 United States government policy prohibits AI-generated and AI-edited photographs in passport applications, and applications are screened for them. Submitting one can cause your application to be rejected or delayed, and may have consequences beyond that. The rules for other agencies and other countries vary and can change.
5.3 Our "ID Style" category means commercial ID-style portraits — company badges, student cards, résumés, and professional profiles. It does not mean government identification. We do not offer, and will not offer, a passport or visa product.
5.4 You are solely responsible if you ignore this section. This is one of the risks that Section 14 excludes from our liability.
6. Things you may not do
You may not, and may not try to, use the Service to:
- upload a photo of anyone other than yourself (Section 4);
- upload or generate any image depicting a person under 18;
- create sexual, nude, or sexually suggestive imagery, or any image that sexualises anyone;
- create an image of, or that is designed to resemble, a real identifiable public figure — including musicians, idols, actors, athletes, influencers, and politicians — whether by uploading their photo or by describing them in the custom-text box;
- request output "in the style of" a specific living artist, creator, or public figure where doing so would reasonably be expected to infringe intellectual-property, publicity, or other rights;
- impersonate any person, misrepresent who you are, or create output intended to mislead anyone about a person's identity;
- create images for a passport, visa, or other government ID (Section 5);
- create content that is harassing, hateful, defamatory, threatening, or that promotes violence or self-harm;
- create content that is illegal, or that facilitates fraud, extortion, or deception;
- use the Service to build, train, fine-tune, evaluate, or benchmark any AI model, or to build a competing product;
- scrape, crawl, or systematically extract content, or use bots, scripts, or automation against the Service;
- work around, disable, or test our rate limits, spending limits, watermarks, payment gate, or any other technical control;
- buy or take output you have not paid for, or share, resell, or sublicense access to paid features;
- reverse-engineer, decompile, or attempt to extract our prompts, source code, or model configuration;
- interfere with the Service's operation, security, or availability, or with other users' use of it;
- resell the Service or use it on behalf of others as a service bureau without our written agreement; or
- break any law that applies to you while using the Service.
We also apply automated safety instructions to every generation, and our AI provider applies its own safety filters. A request may be refused for reasons neither we nor you can see in advance. A refused generation is not a defect.
7. Your photo, our license, and who owns the output
7.1 You keep ownership of your photo. Uploading does not transfer it to us.
7.2 The permission you give us is narrow. You grant us a limited, non-exclusive, worldwide, royalty-free license to host, store, transmit, reformat, and process your uploaded photo and your generated images solely in order to operate the Service for you — that is, to create the image you asked for, to deliver it to you, to provide customer support, to prevent abuse, and to comply with law. This license is as short as the processing it covers: because we do not retain your photo or your generated images at all (Privacy Policy Section 7.1), the license ends when the request that generated your images ends. There is no retention schedule for it to run against, because there is nothing retained.
7.3 What we will not do with your photo.
- We do not sell, lease, trade, or otherwise profit from your face data.
- We do not use your photo or your generated images to train, fine-tune, or improve any AI model — ours or anyone else's.
- We do not use your photo or your generated images in advertising, marketing, social media, our website, or any public gallery, unless you separately and specifically opt in in writing. Nothing in these Terms grants us marketing rights.
- We contractually require our AI provider not to use your photo to train generalized models. See Privacy Policy Section 5.
7.4 The output is yours. Subject to your compliance with these Terms and to your having paid for it, we assign to you all rights, title, and interest we have (if any) in the images the Service generates from your photo. You may use them personally and commercially — social media, LinkedIn, a résumé, a company profile, printing — subject to Sections 5 and 6.
7.5 "If any" is doing real work in that sentence. Under current United States copyright practice, images generated by AI may not be protectable by copyright at all. We cannot give you rights we do not have, and we make no promise that you can register or enforce copyright in any output.
7.6 Other people may get similar images. The Service is used by many people, and AI models produce similar output for similar requests. Our assignment in Section 7.4 does not cover output generated for other users, and you get no exclusivity in a style, a pose, a background, or a look.
8. Credits, prices, and payment
8.1 The Service is sold as prepaid credits. You buy credits, then spend them to download high-resolution images. The number of credits an image costs depends on which tier you choose — Basic, 3K, or 4K.
8.2 Current prices and credit costs are shown on our pricing page before you pay. Prices are in US dollars. We may change prices at any time, but a change never affects credits you have already bought.
8.3 There is no subscription and no automatic renewal. We will never charge you on a recurring basis. Every purchase is a one-time purchase that you make on purpose.
8.4 Payments are processed by Stripe, Inc. We never see or store your full card number. Your purchase is also subject to Stripe's terms.
8.5 You are responsible for any applicable sales or use tax, which will be shown at checkout where we are required to collect it.
8.6 Credits do not expire. Credits also have no cash value, are not transferable to another person, and are not redeemable for cash except where a law requires it — see Section 5 of the Refund and Credits Policy, which explains the one case where you can ask us for cash back.
8.7 Everything about refunds is in the Refund and Credits Policy, which is part of this contract.
9. Delivery, storage, and losing your images
9.1 Images are delivered digitally, in your browser, right after generation. There is nothing to ship.
9.2 Save your images when you get them. We are not a storage service and we do not keep your images at all. There is no deletion schedule because there is nothing stored to delete: your photo and the images made from it exist only in memory for the length of the single request that produces them, and nothing of either remains once that response has been sent (Privacy Policy Section 7.1). So they are not "gone later" — they are never held in the first place. We cannot recover an image you did not save, and we will not regenerate one for free because you did not save it in time.
10. Availability, limits, and fair use
10.1 We apply rate limits and daily capacity limits to keep the Service running and to control cost. You may be temporarily refused if you generate very quickly, if you exceed a daily allowance, or if the Service reaches its capacity for the day. This is normal operation, not a fault.
10.2 We may change, suspend, or discontinue any part of the Service — including styles, tiers, and features — at any time. If we discontinue the Service entirely, Section 5 of the Refund and Credits Policy tells you what happens to unused credits.
10.3 We do not promise any particular uptime, speed, or turnaround time. Any time estimate shown in the interface is an estimate.
11. Reporting a problem, and takedowns
11.1 If you believe an image made with the Service depicts a minor, uses your face or someone else's without permission, impersonates a real person, or otherwise breaks these Terms, email abuse@kheadshot.com. Include enough detail for us to find it.
11.2 We aim to acknowledge reports sent to that address within 72 hours and to act on confirmed violations promptly. Because we do not store uploaded photos or the images generated from them (Privacy Policy Section 7.1), there is usually no file for us to take down — the action we can take is against the use of the Service, including refusing service to the person responsible.
11.3 Copyright. If you believe material on the Service infringes your copyright, email legal@kheadshot.com. Tell us what work you own, what material you are complaining about and where it is, how to reach you, and that you have a good-faith belief the use was not authorised by you, your agent, or the law. We will review every notice we receive, and we refuse service to repeat infringers.
11.4 Removing your own data. There is nothing to remove: we do not store your photo or the images generated from it, so withdrawing your consent to face-data processing takes effect simply by your not uploading again. Privacy Policy Sections 7.1 and 9 explain this in full.
12. Suspension and termination
12.1 You may stop using the Service at any time.
12.2 We may suspend or terminate your access, with or without notice, if we reasonably believe you have broken these Terms, if we are required to by law, or if your use creates risk or cost we are not willing to carry.
12.3 If we terminate you for breaking these Terms, you lose access to unused credits and we do not owe you a refund for them, except where a law requires one. If we terminate you for any other reason, or if we discontinue the Service, Section 5 of the Refund and Credits Policy applies.
12.4 Sections 4, 5, 6, 7, 13, 14, 15, 16, and 17 survive termination.
13. Disclaimers
13.1 THE SERVICE AND ALL OUTPUT ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
13.2 WE DO NOT WARRANT THAT ANY OUTPUT WILL BE ACCURATE, FLATTERING, RECOGNISABLE AS YOU, UNIQUE, NON-INFRINGING, OR SUITABLE FOR ANY PARTICULAR PURPOSE, INCLUDING ANY PROFESSIONAL, EMPLOYMENT, OR OFFICIAL PURPOSE.
13.3 YOU ACKNOWLEDGE THAT AI OUTPUT MAY BE SIMILAR OR IDENTICAL TO OUTPUT GENERATED FOR OTHER USERS OR TO EXISTING THIRD-PARTY CONTENT, AND THAT WE DO NOT CONTROL THE TRAINING DATA OR INTERNAL BEHAVIOUR OF THE THIRD-PARTY MODELS WE USE.
13.4 WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.
13.5 Some states do not allow the exclusion of certain warranties. In those states, the exclusions above apply only to the extent the law allows, and you may have additional rights.
14. Limitation of liability
14.1 TO THE FULLEST EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, BUSINESS OPPORTUNITY, OR REPUTATION, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY.
14.2 WE ARE NOT LIABLE FOR: (a) any consequence of your using output in a government identification application; (b) any employment, business, academic, or immigration decision made because of an image from the Service; (c) any dissatisfaction with how an image looks; or (d) loss of images you did not download.
14.3 TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (a) THE AMOUNT YOU PAID US IN THE THREE (3) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (b) ONE HUNDRED US DOLLARS ($100).
14.4 Some states do not allow these limits. In those states, they apply only to the extent the law allows.
15. Indemnity
You agree to defend, indemnify, and hold harmless K Headshot and its owners, officers, employees, and agents from any claim, demand, loss, liability, or expense (including reasonable legal fees) arising out of: (a) your breach of these Terms; (b) any photo you upload, including any claim by a person shown in it; (c) your use of any output, including any use in a government ID application; or (d) your violation of any law or of anyone's rights.
16. Disputes: informal resolution first, then arbitration
16.1 Email us first. Before starting arbitration or any legal action, you agree to email legal@kheadshot.com with a short description of the problem and what you want. We will do the same for you. Give us 30 days to work it out. Most problems end here.
16.2 Arbitration. If we cannot resolve it, you and we agree that any dispute relating to the Service or these Terms will be resolved by binding individual arbitration administered by JAMS under its consumer arbitration rules, rather than in court. The Federal Arbitration Act governs this section.
16.3 What is not covered. Either of us may still (a) bring an individual claim in small claims court, and (b) seek an injunction in court to stop infringement or misuse of intellectual property.
16.4 No class actions. YOU AND WE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY INDIVIDUALLY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING. THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON'S CLAIMS.
16.5 You can opt out. You may opt out of Sections 16.2 and 16.4 by sending written notice to 12100 Wilshire Blvd, 8th Floor, Los Angeles, CA 90025, or legal@kheadshot.com within 30 days of first accepting these Terms. Include your name, the email you used, and a clear statement that you are opting out of arbitration. Opting out costs you nothing and changes nothing else about your relationship with us.
16.6 Jury trial waiver. Except as stated in 16.3 and 16.5, you and we waive the right to a jury trial.
16.7 Severability. If Section 16.4 is found unenforceable as to a particular claim, that claim — and only that claim — will proceed in court, and the rest of this Section 16 still applies.
17. Governing law and where disputes are heard
These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. For anything not subject to arbitration, you and we submit to the exclusive jurisdiction of the state and federal courts located in Los Angeles County, California. Nothing here takes away consumer-protection rights that the law of your home state gives you and does not allow you to waive.
18. Changes to these Terms
18.1 We may update these Terms. When we do, we will change the "Last updated" date at the top and post the new version here.
18.2 If a change is material, we will post notice of it on the site before it takes effect. Joining the waitlist is not a request to be notified about changes to these Terms: a waitlist address is used for one notice about credits opening and nothing else (Privacy Policy Sections 2 and 3).
18.3 Continuing to use the Service after a change takes effect means you accept it. If you do not accept it, stop using the Service; Section 5 of the Refund and Credits Policy tells you what happens to unused credits.
18.4 A change to these Terms never changes how we may use face data you gave us before the change. If we want to use it differently, we will ask for your consent again.
19. The rest
19.1 Entire agreement. These Terms, the Privacy Policy, and the Refund and Credits Policy are the entire agreement between you and us about the Service.
19.2 Severability. If any part is found unenforceable, the rest stays in effect.
19.3 No waiver. If we do not enforce something right away, we have not given up the right to enforce it later.
19.4 Assignment. You may not transfer your rights under these Terms. We may transfer ours in connection with a merger, acquisition, or sale of assets, on notice to you.
19.5 Force majeure. We are not liable for delays or failures caused by events outside our reasonable control, including outages at our AI provider, hosting provider, or payment processor.
19.6 Headings are for convenience only.
